She testified that he tried to stab her with a syringe, which she said she knocked away, and that he then struck her head repeatedly with a rock. She recounted him saying things like, “You’re done. We’re done with you. We don’t need you anymore. You’re done. You’re done. ” She also said she yelled, “He’s trying to kill me, ” during the attack.

A witness who called 911 described her as being covered in blood. A physician who examined her injuries testified that she sustained crushed tissue down to the skull, with small pieces of rock embedded in her skin, and that the doctor could not determine how many times she was struck. The physician said brain function appeared normal. Konig later told her personal doctor she had suffered a traumatic brain injury.

How the Defense and Prosecution Framed the Case

The defendant faces a charge of second-degree attempted murder and faces up to life in prison if convicted. The defense contends the altercation began when the wife attacked after a confrontation about an affair; the defense described a sequence in which she picked up a rock and hit him, prompting a quick reaction. The defense also pointed to a call the defendant made to his adult son in which he expressed suicidal intent.

Prosecutors described the same call differently, arguing it was a confession in which the defendant said he had tried to kill his wife but that she got away. The prosecution has also presented the accounts of medical personnel and a witness who called 911 to build its case.
